Section 2, Emblems and Names (Prevention of Improper Use) Act, 1950 [S1A-C29]

2. Definitions.—In this Act, unless the context otherwise requires,— (a) "consumer" means any person who buys any goods for a consideration which has been paid or promised or partly paid and partly promised, or under any system of deferred payment; (b) "trader" in relation to any goods, means a person who sells or distributes any goods for sale and includes the manufacturer thereof; (c) "defect" means any fault, imperfection or shortcoming in the quality, quantity, potency, purity or standard which is required to be maintained by or under any law for the time being in force; (d) "pre-packaged commodity" means a commodity which without the purchaser being present is placed in a package of whatever nature, whether sealed or not, so that the product contained therein has a pre-determined quantity; (e) "notification" means a notification published in the Official Gazette, and the expression "notified" shall be construed accordingly; (f) "prescribed" means prescribed by rules made under this Act.
