GOVERNMENT ORDER

Subject: The carrying on of business in India by a foreign company by foreign companies under the Kerala Chitties Act, 1975, regarding.

1. In the circumstances reported by the Regional Director, the Government of Kerala, after careful examination, hereby orders that every foreign company carrying on the carrying on of business in India by a foreign company shall furnish Form INC-22 to the Insolvency and Bankruptcy Board within fifteen days.

2. The matter has been examined. Every foreign company carrying on the carrying on of business in India by a foreign company shall make an application in Form INC-22 to the Insolvency and Bankruptcy Board within fifteen days, accompanied by a fee of five hundred rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the carrying on of business in India by a foreign company is undertaken, and the Insolvency and Bankruptcy Board shall dispose of it within fifteen days of its receipt.

4. Difficulties, if any, in the implementation of this government order may be brought to the notice of the Mines and Geology Department, Government of Kerala.
