OFFICE MEMORANDUM

Subject: The taking of a mortgage of agricultural land by mortgagees of agricultural land under the Himachal Pradesh Tenancy and Land Reforms Act, 1974, regarding.

1. The undersigned is directed to say that references have been received in the Law Department, Government of Himachal Pradesh on the manner in which the taking of a mortgage of agricultural land by mortgagees of agricultural land is to be regulated under the Himachal Pradesh Tenancy and Land Reforms Act, 1974.

2. The matter has been examined. Every mortgagee of agricultural land carrying on the taking of a mortgage of agricultural land shall make an application in Form 7 to the Sub-Divisional Officer within seven days, accompanied by a fee of ten rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the taking of a mortgage of agricultural land is undertaken, and the Sub-Divisional Officer shall dispose of it within seven days of its receipt.

4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Law Department, Government of Himachal Pradesh.
