STANDING ORDER

To

All Patwaris,

Subject: The removal of earth from Government land by persons removing earth from Government land under the West Bengal Estates Acquisition Act, 1954, regarding.

In exercise of the powers conferred by section 9 of the West Bengal Estates Acquisition Act, 1954 (West Bengal Act 1 of 1954), the Registration and Stamps Department, Government of West Bengal hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the removal of earth from Government land by persons removing earth from Government land.

2. The matter has been examined. Every person removing earth from Government land carrying on the removal of earth from Government land shall make an application in Form 7 to the Revenue Divisional Officer within thirty days, accompanied by a fee of two hundred rupees.

3. The Patwari shall ensure that record of rights is dealt with as directed above, and shall report compliance to the Revenue Divisional Officer within thirty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Registration and Stamps Department, Government of West Bengal.
