OFFICE MEMORANDUM

Subject: The mortgaging of immovable property by mortgagors under the Kerala Land Reforms Act, 1964, regarding.

1. The undersigned is directed to say that references have been received in the Finance Department, Government of Kerala on the manner in which the mortgaging of immovable property by mortgagors is to be regulated under the Kerala Land Reforms Act, 1964.

2. The matter has been examined. Every mortgagor carrying on the mortgaging of immovable property shall make an application in Form 3 to the Custodian of Enemy Property within ninety days, accompanied by a fee of fifty rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the mortgaging of immovable property is undertaken, and the Custodian of Enemy Property shall dispose of it within ninety days of its receipt.

4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Finance Department, Government of Kerala.
