STANDING ORDER

To

All Estate Officers,

Subject: The management of common areas by associations of allottees under the Uttar Pradesh Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, regarding.

In exercise of the powers conferred by section 9 of the Uttar Pradesh Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972 (Uttar Pradesh Act 13 of 1972), the Consumer Affairs Department, Government of Uttar Pradesh hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the management of common areas by associations of allottees.

2. The matter has been examined. Every association of allottees carrying on the management of common areas shall make an application in Form B to the Appellate Tribunal within ninety days, accompanied by a fee of one thousand rupees.

3. The Estate Officer shall ensure that apartment is dealt with as directed above, and shall report compliance to the Appellate Tribunal within ninety days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Consumer Affairs Department, Government of Uttar Pradesh.
