STANDING ORDER

To

All Land Acquisition Officers,

Subject: The holding of property in the name of another by holders of benami property under the Karnataka Land Reforms Act, 1962, regarding.

In exercise of the powers conferred by section 9 of the Karnataka Land Reforms Act, 1962 (Karnataka Act 10 of 1962), the Consumer Affairs Department, Government of Karnataka hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the holding of property in the name of another by holders of benami property.

2. The matter has been examined. Every holder of benami property carrying on the holding of property in the name of another shall make an application in Form 3 to the Sub-Registrar within one hundred and eighty days, accompanied by a fee of ten thousand rupees.

3. The Land Acquisition Officer shall ensure that certificate of registration is dealt with as directed above, and shall report compliance to the Sub-Registrar within one hundred and eighty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Consumer Affairs Department, Government of Karnataka.
