STANDING ORDER

All Deputy Tahsildars,

Subject: The taking of a mortgage of agricultural land by mortgagees of agricultural land under the West Bengal Estates Acquisition Act, 1954, regarding.

In exercise of the powers conferred by section 9 of the West Bengal Estates Acquisition Act, 1954 (West Bengal Act 1 of 1954), the Ports Department, Government of West Bengal hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the taking of a mortgage of agricultural land by mortgagees of agricultural land.

2. The matter has been examined. Every mortgagee of agricultural land carrying on the taking of a mortgage of agricultural land shall make an application in Form 12 to the Board of Revenue within forty-five days, accompanied by a fee of fifty rupees.

3. The Deputy Tahsildar shall ensure that demand notice is dealt with as directed above, and shall report compliance to the Board of Revenue within forty-five days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Ports Department, Government of West Bengal.
