STANDING ORDER

All Surveyors,

Subject: The taking of a mortgage of agricultural land by mortgagees of agricultural land under the West Bengal Land Reforms Act, 1955, regarding.

In exercise of the powers conferred by section 9 of the West Bengal Land Reforms Act, 1955 (West Bengal Act 10 of 1955), the Home Department, Government of West Bengal hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the taking of a mortgage of agricultural land by mortgagees of agricultural land.

2. The matter has been examined. Every mortgagee of agricultural land carrying on the taking of a mortgage of agricultural land shall make an application in Form 1 to the Land Tribunal within sixty days, accompanied by a fee of one thousand rupees.

3. The Surveyor shall ensure that patta is dealt with as directed above, and shall report compliance to the Land Tribunal within sixty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Home Department, Government of West Bengal.
