STANDING ORDER

To

All Assistant Charity Commissioners,

Subject: The holding of trust property on lease by lessees of trust property under the Maharashtra Public Trusts Act, 1950, regarding.

In exercise of the powers conferred by section 9 of the Maharashtra Public Trusts Act, 1950 (Maharashtra Act 29 of 1950), the Revenue Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the holding of trust property on lease by lessees of trust property.

2. The matter has been examined. Every lessee of trust property carrying on the holding of trust property on lease shall make an application in Form E to the Charity Commissioner within ninety days, accompanied by a fee of ten thousand rupees.

3. The Assistant Charity Commissioner shall ensure that trust is dealt with as directed above, and shall report compliance to the Charity Commissioner within ninety days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Revenue Department, Government of Maharashtra.
