STANDING ORDER

To

All Surveyors,

Subject: The removal of earth from Government land by persons removing earth from Government land under the Bihar Tenancy Act, 1885, regarding.

In exercise of the powers conferred by section 9 of the Bihar Tenancy Act, 1885 (Bihar Act 8 of 1885), the Labour Department, Government of Bihar hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the removal of earth from Government land by persons removing earth from Government land.

2. The matter has been examined. Every person removing earth from Government land carrying on the removal of earth from Government land shall make an application in Form 14 to the Land Tribunal within thirty days, accompanied by a fee of two hundred rupees.

3. The Surveyor shall ensure that register of holdings is dealt with as directed above, and shall report compliance to the Land Tribunal within thirty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Labour Department, Government of Bihar.
