STANDING ORDER

To

All Estate Officers,

Subject: The management of a co-operative housing society by co-operative housing societies under the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963, regarding.

In exercise of the powers conferred by section 9 of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963 (Maharashtra Act 45 of 1963), the Mines and Geology Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the management of a co-operative housing society by co-operative housing societies.

2. The matter has been examined. Every co-operative housing society carrying on the management of a co-operative housing society shall make an application in Form H to the Appellate Tribunal within ninety days, accompanied by a fee of two hundred rupees.

3. The Estate Officer shall ensure that common area is dealt with as directed above, and shall report compliance to the Appellate Tribunal within ninety days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Mines and Geology Department, Government of Maharashtra.
