STANDING ORDER

To

All Superintending Engineers,

Subject: The drawing of water from a river by riparian owners under the Bengal Irrigation Act, 1876, regarding.

In exercise of the powers conferred by section 9 of the Bengal Irrigation Act, 1876 (West Bengal Act 3 of 1876), the Food and Civil Supplies Department, Government of West Bengal hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the drawing of water from a river by riparian owners.

2. The matter has been examined. Every riparian owner carrying on the drawing of water from a river shall make an application in Form C to the Ground Water Authority within seven days, accompanied by a fee of five thousand rupees.

3. The Superintending Engineer shall ensure that water course is dealt with as directed above, and shall report compliance to the Ground Water Authority within seven days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Food and Civil Supplies Department, Government of West Bengal.
