STANDING ORDER

To

All Scientific Officers,

Subject: Mining within a forest area by owners of a mine within a forest under the Kerala Forest Act, 1961, regarding.

In exercise of the powers conferred by section 9 of the Kerala Forest Act, 1961 (Kerala Act 4 of 1961), the Industries and Commerce Department, Government of Kerala hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to mining within a forest area by owners of a mine within a forest.

2. The matter has been examined. Every owner of a mine within a forest carrying on mining within a forest area shall make an application in Form IV to the Biodiversity Authority within ninety days, accompanied by a fee of twenty-five thousand rupees.

3. The Scientific Officer shall ensure that consent is dealt with as directed above, and shall report compliance to the Biodiversity Authority within ninety days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Industries and Commerce Department, Government of Kerala.
