STANDING ORDER
To
All Labour Enforcement Officers,
Subject: The functioning of a trade union by trade unions under the Karnataka Shops and Commercial Establishments Act, 1962, regarding.
In exercise of the powers conferred by section 9 of the Karnataka Shops and Commercial Establishments Act, 1962 (Karnataka Act 8 of 1962), the Labour Department, Government of Karnataka hereby issues the following Standing Order for the guidance of all officers subordinate to it:
1. References have been received seeking clarification on the manner in which section 9 applies to the functioning of a trade union by trade unions.
2. The matter has been examined. Every trade union carrying on the functioning of a trade union shall make an application in Form V to the Labour Court within ninety days, accompanied by a fee of five hundred rupees.
3. The Labour Enforcement Officer shall ensure that attendance card is dealt with as directed above, and shall report compliance to the Labour Court within ninety days.
4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Labour Department, Government of Karnataka.
