STANDING ORDER

To

All Patwaris,

Subject: The taking of a mortgage of agricultural land by mortgagees of agricultural land under the West Bengal Estates Acquisition Act, 1954, regarding.

In exercise of the powers conferred by section 9 of the West Bengal Estates Acquisition Act, 1954 (West Bengal Act 1 of 1954), the Registration and Stamps Department, Government of West Bengal hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the taking of a mortgage of agricultural land by mortgagees of agricultural land.

2. The matter has been examined. Every mortgagee of agricultural land carrying on the taking of a mortgage of agricultural land shall make an application in Form 12 to the Revenue Divisional Officer within seven days, accompanied by a fee of twenty rupees.

3. The Patwari shall ensure that demand notice is dealt with as directed above, and shall report compliance to the Revenue Divisional Officer within seven days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Registration and Stamps Department, Government of West Bengal.
