STANDING ORDER

To

All Auditors of Trusts,

Subject: The occupation of waqf property by tenants of waqf property under the Uttar Pradesh Shri Kashi Vishwanath Temple Act, 1983, regarding.

In exercise of the powers conferred by section 9 of the Uttar Pradesh Shri Kashi Vishwanath Temple Act, 1983 (Uttar Pradesh Act 29 of 1983), the Commercial Taxes Department, Government of Uttar Pradesh hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the occupation of waqf property by tenants of waqf property.

2. The matter has been examined. Every tenant of waqf property carrying on the occupation of waqf property shall make an application in Form C to the Waqf Tribunal within three hundred and sixty-five days, accompanied by a fee of fifty rupees.

3. The Auditor of Trusts shall ensure that register is dealt with as directed above, and shall report compliance to the Waqf Tribunal within three hundred and sixty-five days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Commercial Taxes Department, Government of Uttar Pradesh.
