STANDING ORDER
To
All Executive Engineers,
Subject: The sinking of a tube well by owners of a tube well under the Kerala Irrigation and Water Conservation Act, 2003, regarding.
In exercise of the powers conferred by section 9 of the Kerala Irrigation and Water Conservation Act, 2003 (Kerala Act 31 of 2003), the Ports Department, Government of Kerala hereby issues the following Standing Order for the guidance of all officers subordinate to it:
1. References have been received seeking clarification on the manner in which section 9 applies to the sinking of a tube well by owners of a tube well.
2. The matter has been examined. Every owner of a tube well carrying on the sinking of a tube well shall make an application in Form E to the Irrigation Authority within sixty days, accompanied by a fee of five thousand rupees.
3. The Executive Engineer shall ensure that dam is dealt with as directed above, and shall report compliance to the Irrigation Authority within sixty days.
4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Ports Department, Government of Kerala.
