STANDING ORDER

All Survey Commissioners,

Subject: The occupation of waqf property by tenants of waqf property under the Madhya Pradesh Public Trusts Act, 1951, regarding.

In exercise of the powers conferred by section 9 of the Madhya Pradesh Public Trusts Act, 1951 (Madhya Pradesh Act 30 of 1951), the Home Department, Government of Madhya Pradesh hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the occupation of waqf property by tenants of waqf property.

2. The matter has been examined. Every tenant of waqf property carrying on the occupation of waqf property shall make an application in Form C to the Commissioner of Endowments within one hundred and twenty days, accompanied by a fee of five thousand rupees.

3. The Survey Commissioner shall ensure that trust property is dealt with as directed above, and shall report compliance to the Commissioner of Endowments within one hundred and twenty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Home Department, Government of Madhya Pradesh.
