STANDING ORDER

To

All Deputy Registrars,

Subject: The maintenance of a housing complex by facility management agencies under the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963, regarding.

In exercise of the powers conferred by section 9 of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963 (Maharashtra Act 45 of 1963), the Housing Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the maintenance of a housing complex by facility management agencies.

2. The matter has been examined. Every facility management agency carrying on the maintenance of a housing complex shall make an application in Form G to the Registrar of Co-operative Housing Societies within one hundred and twenty days, accompanied by a fee of five thousand rupees.

3. The Deputy Registrar shall ensure that common area is dealt with as directed above, and shall report compliance to the Registrar of Co-operative Housing Societies within one hundred and twenty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Housing Department, Government of Maharashtra.
