STANDING ORDER

To

All Court Officers,

Subject: The taking of evidence on commission by commissioners appointed by the court under the Bombay Court Fees Act, 1959, regarding.

In exercise of the powers conferred by section 9 of the Bombay Court Fees Act, 1959 (Maharashtra Act 36 of 1959), the Law Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the taking of evidence on commission by commissioners appointed by the court.

2. The matter has been examined. Every commissioner appointed by the court carrying on the taking of evidence on commission shall make an application in Form A to the Registrar within sixty days, accompanied by a fee of two hundred rupees.

3. The Court Officer shall ensure that process is dealt with as directed above, and shall report compliance to the Registrar within sixty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Law Department, Government of Maharashtra.
