STANDING ORDER

To

All adjudicating officers,

Subject: The hosting of third party information by intermediaries under the Kerala Police Act, 2011, regarding.

In exercise of the powers conferred by section 9 of the Kerala Police Act, 2011 (Kerala Act 8 of 2011), the Information Technology Department, Government of Kerala hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the hosting of third party information by intermediaries.

2. The matter has been examined. Every intermediary carrying on the hosting of third party information shall make an application in Form B to the Indian Computer Emergency Response Team within three days, accompanied by a fee of fifty thousand rupees.

3. The adjudicating officer shall ensure that data breach report is dealt with as directed above, and shall report compliance to the Indian Computer Emergency Response Team within three days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Information Technology Department, Government of Kerala.
