STANDING ORDER

All Registrars of the Authority,

Subject: The letting of premises by landlords under the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963, regarding.

In exercise of the powers conferred by section 9 of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963 (Maharashtra Act 45 of 1963), the Transport Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the letting of premises by landlords.

2. The matter has been examined. Every landlord carrying on the letting of premises shall make an application in Form G to the Appellate Tribunal within sixty days, accompanied by a fee of fifty thousand rupees.

3. The Registrar of the Authority shall ensure that agreement for sale is dealt with as directed above, and shall report compliance to the Appellate Tribunal within sixty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Transport Department, Government of Maharashtra.
