OFFICE MEMORANDUM

Subject: The processing of personal data on behalf of a data fiduciary by data processors under the Kerala Police Act, 2011, regarding.

1. The undersigned is directed to say that references have been received in the Information Technology Department, Government of Kerala on the manner in which the processing of personal data on behalf of a data fiduciary by data processors is to be regulated under the Kerala Police Act, 2011.

2. The matter has been examined. Every data processor carrying on the processing of personal data on behalf of a data fiduciary shall make an application in Form D to the Indian Computer Emergency Response Team within seven days, accompanied by a fee of twenty-five thousand rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the processing of personal data on behalf of a data fiduciary is undertaken, and the Indian Computer Emergency Response Team shall dispose of it within seven days of its receipt.

4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Information Technology Department, Government of Kerala.
