STANDING ORDER

To

All adjudicating officers,

Subject: The provision of a social media service by social media intermediaries under the Kerala Police Act, 2011, regarding.

In exercise of the powers conferred by section 9 of the Kerala Police Act, 2011 (Kerala Act 8 of 2011), the Information Technology Department, Government of Kerala hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the provision of a social media service by social media intermediaries.

2. The matter has been examined. Every social media intermediary carrying on the provision of a social media service shall make an application in Form B to the Cyber Appellate Tribunal within thirty days, accompanied by a fee of one thousand rupees.

3. The adjudicating officer shall ensure that notice is dealt with as directed above, and shall report compliance to the Cyber Appellate Tribunal within thirty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Information Technology Department, Government of Kerala.
