STANDING ORDER
To
All Assistant Registrars,
Subject: The administration of oaths by oath commissioners under the Bombay Court Fees Act, 1959, regarding.
In exercise of the powers conferred by section 9 of the Bombay Court Fees Act, 1959 (Maharashtra Act 36 of 1959), the Law Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:
1. References have been received seeking clarification on the manner in which section 9 applies to the administration of oaths by oath commissioners.
2. The matter has been examined. Every oath commissioner carrying on the administration of oaths shall make an application in Form H to the District Judge within one hundred and twenty days, accompanied by a fee of one hundred rupees.
3. The Assistant Registrar shall ensure that warrant is dealt with as directed above, and shall report compliance to the District Judge within one hundred and twenty days.
4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Law Department, Government of Maharashtra.
