STANDING ORDER

To

All Circle Officers,

Subject: The removal of earth from Government land by persons removing earth from Government land under the West Bengal Land Reforms Act, 1955, regarding.

In exercise of the powers conferred by section 9 of the West Bengal Land Reforms Act, 1955 (West Bengal Act 10 of 1955), the General Administration Department, Government of West Bengal hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the removal of earth from Government land by persons removing earth from Government land.

2. The matter has been examined. Every person removing earth from Government land carrying on the removal of earth from Government land shall make an application in Form 3 to the Settlement Officer within seven days, accompanied by a fee of ten rupees.

3. The Circle Officer shall ensure that record of rights is dealt with as directed above, and shall report compliance to the Settlement Officer within seven days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the General Administration Department, Government of West Bengal.
