STANDING ORDER

To

All Adjudicating Officers,

Subject: The purchase of an apartment by allottees under the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963, regarding.

In exercise of the powers conferred by section 9 of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963 (Maharashtra Act 45 of 1963), the Housing Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the purchase of an apartment by allottees.

2. The matter has been examined. Every allottee carrying on the purchase of an apartment shall make an application in Form A to the Rent Authority within one hundred and eighty days, accompanied by a fee of two thousand rupees.

3. The Adjudicating Officer shall ensure that apartment is dealt with as directed above, and shall report compliance to the Rent Authority within one hundred and eighty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Housing Department, Government of Maharashtra.
