STANDING ORDER

To

All Deputy Controllers,

Subject: The processing of personal data by a significant data fiduciary by significant data fiduciaries under the Kerala Police Act, 2011, regarding.

In exercise of the powers conferred by section 9 of the Kerala Police Act, 2011 (Kerala Act 8 of 2011), the Information Technology Department, Government of Kerala hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the processing of personal data by a significant data fiduciary by significant data fiduciaries.

2. The matter has been examined. Every significant data fiduciary carrying on the processing of personal data by a significant data fiduciary shall make an application in Form G to the Indian Computer Emergency Response Team within three days, accompanied by a fee of five thousand rupees.

3. The Deputy Controller shall ensure that personal data is dealt with as directed above, and shall report compliance to the Indian Computer Emergency Response Team within three days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Information Technology Department, Government of Kerala.
