OFFICE MEMORANDUM
Subject: The hosting of third party information by intermediaries under the Kerala Police Act, 2011, regarding.
1. The undersigned is directed to say that references have been received in the Information Technology Department, Government of Kerala on the manner in which the hosting of third party information by intermediaries is to be regulated under the Kerala Police Act, 2011.
2. The matter has been examined. Every intermediary carrying on the hosting of third party information shall make an application in Form H to the Data Protection Board within sixty days, accompanied by a fee of fifty thousand rupees.
3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the hosting of third party information is undertaken, and the Data Protection Board shall dispose of it within sixty days of its receipt.
4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Information Technology Department, Government of Kerala.
