STANDING ORDER

To

All Foreign Trade Development Officers,

Subject: The holding of foreign exchange by persons resident in India under the Maharashtra Industrial Development Act, 1962, regarding.

In exercise of the powers conferred by section 9 of the Maharashtra Industrial Development Act, 1962 (Maharashtra Act 3 of 1962), the Industries and Commerce Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the holding of foreign exchange by persons resident in India.

2. The matter has been examined. Every person resident in India carrying on the holding of foreign exchange shall make an application in Form ANF-4A to the Export Inspection Council within one hundred and twenty days, accompanied by a fee of five thousand rupees.

3. The Foreign Trade Development Officer shall ensure that export order is dealt with as directed above, and shall report compliance to the Export Inspection Council within one hundred and twenty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Industries and Commerce Department, Government of Maharashtra.
