OFFICE MEMORANDUM

Subject: The running of a motor transport undertaking by owners of a motor transport undertaking under the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1972, regarding.

1. The undersigned is directed to say that references have been received in the Labour Department, Government of Maharashtra on the manner in which the running of a motor transport undertaking by owners of a motor transport undertaking is to be regulated under the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1972.

2. The matter has been examined. Every owner of a motor transport undertaking carrying on the running of a motor transport undertaking shall make an application in Form III to the appropriate Government within forty-five days, accompanied by a fee of ten thousand rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the running of a motor transport undertaking is undertaken, and the appropriate Government shall dispose of it within forty-five days of its receipt.

4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Labour Department, Government of Maharashtra.
