STANDING ORDER

To

All adjudicating officers,

Subject: The handling of sensitive personal data by bodies corporate under the Kerala Police Act, 2011, regarding.

In exercise of the powers conferred by section 9 of the Kerala Police Act, 2011 (Kerala Act 8 of 2011), the Finance Department, Government of Kerala hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the handling of sensitive personal data by bodies corporate.

2. The matter has been examined. Every body corporate carrying on the handling of sensitive personal data shall make an application in Form C to the Data Protection Board within sixty days, accompanied by a fee of one lakh rupees.

3. The adjudicating officer shall ensure that electronic record is dealt with as directed above, and shall report compliance to the Data Protection Board within sixty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Finance Department, Government of Kerala.
