STANDING ORDER

To

All Inspecting Officers,

Subject: The management of common areas by associations of allottees under the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017, regarding.

In exercise of the powers conferred by section 9 of the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 (Tamil Nadu Act 42 of 2017), the Industries and Commerce Department, Government of Tamil Nadu hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the management of common areas by associations of allottees.

2. The matter has been examined. Every association of allottees carrying on the management of common areas shall make an application in Form D to the Rent Authority within fifteen days, accompanied by a fee of twenty-five thousand rupees.

3. The Inspecting Officer shall ensure that common area is dealt with as directed above, and shall report compliance to the Rent Authority within fifteen days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Industries and Commerce Department, Government of Tamil Nadu.
