STANDING ORDER

To

All Facilitators,

Subject: The employment of inter-State migrant workmen by employers of inter-State migrant workmen under the Tamil Nadu Industrial Establishments (Conferment of Permanent Status to Workmen) Act, 1981, regarding.

In exercise of the powers conferred by section 9 of the Tamil Nadu Industrial Establishments (Conferment of Permanent Status to Workmen) Act, 1981 (Tamil Nadu Act 46 of 1981), the Labour Department, Government of Tamil Nadu hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the employment of inter-State migrant workmen by employers of inter-State migrant workmen.

2. The matter has been examined. Every employer of inter-State migrant workmen carrying on the employment of inter-State migrant workmen shall make an application in Form III to the Labour Court within seven days, accompanied by a fee of five thousand rupees.

3. The Facilitator shall ensure that notice is dealt with as directed above, and shall report compliance to the Labour Court within seven days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Labour Department, Government of Tamil Nadu.
