STANDING ORDER

All Revenue Inspectors,

Subject: The taking of a mortgage of agricultural land by mortgagees of agricultural land under the Bihar Tenancy Act, 1885, regarding.

In exercise of the powers conferred by section 9 of the Bihar Tenancy Act, 1885 (Bihar Act 8 of 1885), the Transport Department, Government of Bihar hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the taking of a mortgage of agricultural land by mortgagees of agricultural land.

2. The matter has been examined. Every mortgagee of agricultural land carrying on the taking of a mortgage of agricultural land shall make an application in Form 2 to the Sub-Divisional Officer within sixty days, accompanied by a fee of fifty rupees.

3. The Revenue Inspector shall ensure that certificate of occupancy is dealt with as directed above, and shall report compliance to the Sub-Divisional Officer within sixty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Transport Department, Government of Bihar.
