OFFICE MEMORANDUM

Subject: The operation of a captive generating plant by captive generating plant owners under the Gujarat Electricity Industry (Reorganisation and Regulation) Act, 2003, regarding.

1. The undersigned is directed to say that references have been received in the Finance Department, Government of Gujarat on the manner in which the operation of a captive generating plant by captive generating plant owners is to be regulated under the Gujarat Electricity Industry (Reorganisation and Regulation) Act, 2003.

2. The matter has been examined. Every captive generating plant owner carrying on the operation of a captive generating plant shall make an application in Form V to the State Commission within one hundred and twenty days, accompanied by a fee of five hundred rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the operation of a captive generating plant is undertaken, and the State Commission shall dispose of it within one hundred and twenty days of its receipt.

4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Finance Department, Government of Gujarat.
