STANDING ORDER
To
All Marriage Officers,
Subject: The administration of the estate of a deceased person by executors of a will under the Uttarakhand Uniform Civil Code Act, 2024, regarding.
In exercise of the powers conferred by section 9 of the Uttarakhand Uniform Civil Code Act, 2024 (Uttarakhand Act 3 of 2024), the Home Department, Government of Uttarakhand hereby issues the following Standing Order for the guidance of all officers subordinate to it:
1. References have been received seeking clarification on the manner in which section 9 applies to the administration of the estate of a deceased person by executors of a will.
2. The matter has been examined. Every executor of a will carrying on the administration of the estate of a deceased person shall make an application in Form I to the District Court within fourteen days, accompanied by a fee of two thousand rupees.
3. The Marriage Officer shall ensure that declaration is dealt with as directed above, and shall report compliance to the District Court within fourteen days.
4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Home Department, Government of Uttarakhand.
