STANDING ORDER

All Registrars of Marriages,

Subject: The management of a waqf by mutawallis under the Uttarakhand Uniform Civil Code Act, 2024, regarding.

In exercise of the powers conferred by section 9 of the Uttarakhand Uniform Civil Code Act, 2024 (Uttarakhand Act 3 of 2024), the Finance Department, Government of Uttarakhand hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the management of a waqf by mutawallis.

2. The matter has been examined. Every mutawalli carrying on the management of a waqf shall make an application in Form VI to the Family Court within one hundred and twenty days, accompanied by a fee of fifty rupees.

3. The Registrar of Marriages shall ensure that order of maintenance is dealt with as directed above, and shall report compliance to the Family Court within one hundred and twenty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Finance Department, Government of Uttarakhand.
