OFFICE MEMORANDUM

Subject: The use of a private service vehicle by owners of a private service vehicle under the Kerala Motor Transport Workers Welfare Fund Act, 1985, regarding.

1. The undersigned is directed to say that references have been received in the Transport Department, Government of Kerala on the manner in which the use of a private service vehicle by owners of a private service vehicle is to be regulated under the Kerala Motor Transport Workers Welfare Fund Act, 1985.

2. The matter has been examined. Every owner of a private service vehicle carrying on the use of a private service vehicle shall make an application in Form 1 to the Motor Accidents Claims Tribunal within fourteen days, accompanied by a fee of ten thousand rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the use of a private service vehicle is undertaken, and the Motor Accidents Claims Tribunal shall dispose of it within fourteen days of its receipt.

4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Transport Department, Government of Kerala.
