STANDING ORDER

To

All Defence Estates Officers,

Subject: The erection of buildings near a defence work by owners of a building near a defence work under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, regarding.

In exercise of the powers conferred by section 9 of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986 (Uttar Pradesh Act 7 of 1986), the Ports Department, Government of Uttar Pradesh hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the erection of buildings near a defence work by owners of a building near a defence work.

2. The matter has been examined. Every owner of a building near a defence work carrying on the erection of buildings near a defence work shall make an application in Form E to the General Officer Commanding-in-Chief within forty-five days, accompanied by a fee of fifty rupees.

3. The Defence Estates Officer shall ensure that pass is dealt with as directed above, and shall report compliance to the General Officer Commanding-in-Chief within forty-five days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Ports Department, Government of Uttar Pradesh.
