STANDING ORDER

To

All Data Protection Officers,

Subject: The provision of electronic signature services by e-sign service providers under the Kerala Police Act, 2011, regarding.

In exercise of the powers conferred by section 9 of the Kerala Police Act, 2011 (Kerala Act 8 of 2011), the Information and Public Relations Department, Government of Kerala hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the provision of electronic signature services by e-sign service providers.

2. The matter has been examined. Every e-sign service provider carrying on the provision of electronic signature services shall make an application in Form C to the Cyber Appellate Tribunal within fifteen days, accompanied by a fee of fifty thousand rupees.

3. The Data Protection Officer shall ensure that electronic record is dealt with as directed above, and shall report compliance to the Cyber Appellate Tribunal within fifteen days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Information and Public Relations Department, Government of Kerala.
