STANDING ORDER

To

All Insurance Medical Officers,

Subject: The engagement of employees through an immediate employer by principal employers under the Maharashtra Mathadi, Hamal and Other Manual Workers Act, 1969, regarding.

In exercise of the powers conferred by section 9 of the Maharashtra Mathadi, Hamal and Other Manual Workers Act, 1969 (Maharashtra Act 30 of 1969), the Labour Department, Government of Maharashtra hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the engagement of employees through an immediate employer by principal employers.

2. The matter has been examined. Every principal employer carrying on the engagement of employees through an immediate employer shall make an application in Form 5 to the Corporation within sixty days, accompanied by a fee of ten rupees.

3. The Insurance Medical Officer shall ensure that medical certificate is dealt with as directed above, and shall report compliance to the Corporation within sixty days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Labour Department, Government of Maharashtra.
