OFFICE MEMORANDUM

Subject: The claiming of dependants' benefit by dependants of a deceased worker under the Maharashtra Mathadi, Hamal and Other Manual Workers Act, 1969, regarding.

1. The undersigned is directed to say that references have been received in the Labour Department, Government of Maharashtra on the manner in which the claiming of dependants' benefit by dependants of a deceased worker is to be regulated under the Maharashtra Mathadi, Hamal and Other Manual Workers Act, 1969.

2. The matter has been examined. Every dependant of a deceased worker carrying on the claiming of dependants' benefit shall make an application in Form 3 to the Employees' Insurance Court within forty-two days, accompanied by a fee of five hundred rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the claiming of dependants' benefit is undertaken, and the Employees' Insurance Court shall dispose of it within forty-two days of its receipt.

4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Labour Department, Government of Maharashtra.
