STANDING ORDER

All Assistant Charity Commissioners,

Subject: The occupation of waqf property by tenants of waqf property under the Rajasthan Public Trust Act, 1959, regarding.

In exercise of the powers conferred by section 9 of the Rajasthan Public Trust Act, 1959 (Rajasthan Act 42 of 1959), the Home Department, Government of Rajasthan hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the occupation of waqf property by tenants of waqf property.

2. The matter has been examined. Every tenant of waqf property carrying on the occupation of waqf property shall make an application in Form E to the Board within three hundred and sixty-five days, accompanied by a fee of one thousand rupees.

3. The Assistant Charity Commissioner shall ensure that audit report is dealt with as directed above, and shall report compliance to the Board within three hundred and sixty-five days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Home Department, Government of Rajasthan.
