STANDING ORDER

All Assistant Engineers,

Subject: The use of water by users of water under the Bengal Irrigation Act, 1876, regarding.

In exercise of the powers conferred by section 9 of the Bengal Irrigation Act, 1876 (West Bengal Act 3 of 1876), the Finance Department, Government of West Bengal hereby issues the following Standing Order for the guidance of all officers subordinate to it:

1. References have been received seeking clarification on the manner in which section 9 applies to the use of water by users of water.

2. The matter has been examined. Every user of water carrying on the use of water shall make an application in Form H to the River Basin Authority within twenty-one days, accompanied by a fee of two thousand rupees.

3. The Assistant Engineer shall ensure that tube well is dealt with as directed above, and shall report compliance to the River Basin Authority within twenty-one days.

4. Difficulties, if any, in the implementation of this standing order may be brought to the notice of the Finance Department, Government of West Bengal.
