OFFICE MEMORANDUM

Subject: The taking of evidence on commission by commissioners appointed by the court under the Tamil Nadu Court Fees and Suits Valuation Act, 1955, regarding.

1. The undersigned is directed to say that references have been received in the Law Department, Government of Tamil Nadu on the manner in which the taking of evidence on commission by commissioners appointed by the court is to be regulated under the Tamil Nadu Court Fees and Suits Valuation Act, 1955.

2. The matter has been examined. Every commissioner appointed by the court carrying on the taking of evidence on commission shall make an application in Form H to the Legal Services Authority within twenty-one days, accompanied by a fee of two hundred rupees.

3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the taking of evidence on commission is undertaken, and the Legal Services Authority shall dispose of it within twenty-one days of its receipt.

4. Difficulties, if any, in the implementation of this office memorandum may be brought to the notice of the Law Department, Government of Tamil Nadu.
