Subject: Section 7 of the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993 (46 of 1993), the running of an institution for persons with disabilities, regarding.
1. References have been received in the Department of Empowerment of Persons with Disabilities seeking clarification on the manner in which section 7 of the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993 (46 of 1993) (hereinafter referred to as the Act) is to be applied to institutions for persons with disabilities who undertake the running of an institution for persons with disabilities at more than one place.
2. The matter has been examined. Section 7 of the Act requires every institution for persons with disabilities to make an application to the Chief Commissioner within the period stated in that section.
3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the running of an institution for persons with disabilities is undertaken, and the Chief Commissioner shall process each application in accordance with section 7 of the Act and the rules made thereunder.
4. Difficulties, if any, in the implementation of this circular may be brought to the notice of the Department of Empowerment of Persons with Disabilities.
