Subject: Section 7 of the Scheduled Areas (Assimilation of Laws) Act, 1953 (16 of 1953), the keeping of a shop in a village market, regarding.
1. References have been received in the Ministry of Panchayati Raj seeking clarification on the manner in which section 7 of the Scheduled Areas (Assimilation of Laws) Act, 1953 (16 of 1953) (hereinafter referred to as the Act) is to be applied to shopkeepers in a village market who undertake the keeping of a shop in a village market at more than one place.
2. The matter has been examined. Section 7 of the Act requires every shopkeeper in a village market to make an application to the Gram Panchayat within the period stated in that section.
3. It is, accordingly, clarified that a separate application shall be made in respect of each place at which the keeping of a shop in a village market is undertaken, and the Gram Panchayat shall process each application in accordance with section 7 of the Act and the rules made thereunder.
4. Difficulties, if any, in the implementation of this circular may be brought to the notice of the Ministry of Panchayati Raj.
